Privacy Policy

Obeya.studio (operated by David van Noort, sole proprietor, KvK: 99560208) is committed to protecting your privacy. This policy explains what personal data we collect, why we collect it, and how we handle it when you visit obeya.studio or interact with our services.

1.1 Information We Collect

We collect the following categories of personal information:

  • Contact details — name, email address, job title, and company name (provided when you fill in a contact or inquiry form).
  • Usage data — IP address, browser type, pages visited, and session duration, collected automatically via cookies and analytics tools.
  • Communications — the content of emails or messages you send us.
  • Payment information — if you purchase a training or consulting package, payment is processed by a third-party provider (e.g., Stripe) and we do not store card details.

1.2 How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and deliver the services you requested.
  • Schedule discovery calls and manage consulting or training engagements.
  • Send you relevant updates, articles, or offers — only if you have given explicit consent.
  • Improve the performance and content of our website through analytics.
  • Comply with applicable legal obligations.
We do not sell your personal data to third parties. We do not use your data for automated decision-making or profiling.

1.3 Sharing of Information

We share data only where necessary and with appropriate safeguards:

  • Service providers — cloud hosting, email delivery, scheduling tools (e.g., Calendly), and payment processors. These parties are contractually bound to use your data only to provide the relevant service.
  • Legal compliance — if required by law, court order, or to protect the rights and safety of Obeya.studio or others.

We do not share your data with advertising networks or data brokers.

1.4 Your Privacy Rights (U.S. Residents)

Depending on your state of residence, you may have the following rights under applicable state privacy laws (including CCPA/CPRA for California residents, and similar laws in Virginia, Colorado, and other states):

  • Right to know — request details about the personal information we hold about you.
  • Right to correct — request correction of inaccurate personal information.
  • Right to delete — request deletion of your personal information, subject to certain exceptions.
  • Right to opt out — opt out of the sale or sharing of your personal information (we do not sell data, but you may still submit this request).
  • Right to non-discrimination — we will not discriminate against you for exercising any of these rights.
To exercise your rights, please email info@obeya.studio with the subject line "Privacy Rights Request." We will respond within 45 days.

1.5 Data Retention

We retain personal data only as long as necessary to fulfill the purposes described above, or as required by law. Contact and inquiry data is typically retained for up to 3 years after our last interaction. You may request deletion at any time.

1.6 Cookies and Tracking Technologies

We use cookies and similar technologies for the following purposes:

  • Essential cookies — required for the website to function correctly.
  • Analytics cookies — to understand how visitors use our site (e.g., via Google Analytics). These are only activated with your consent.

You can manage or withdraw cookie consent at any time via your browser settings or our cookie preference panel. Note that disabling certain cookies may affect website functionality.

1.7 Data Security

We implement industry-standard technical and organizational measures to protect your personal data against unauthorized access, loss, or misuse. However, no internet transmission is fully secure, and we cannot guarantee absolute security.

We serve clients in the United States and internationally, offering Obeya methodology training, consulting, and coaching services.

2.2 Use of This Website

You may use obeya.studio for lawful purposes only. You agree not to:

  • Use the website in any way that violates applicable U.S. federal, state, or local law.
  • Infringe upon the intellectual property rights of Obeya.studio or any third party.
  • Transmit unsolicited commercial communications (spam), or engage in automated scraping, harvesting, or extraction of content for any purpose, including the training or fine-tuning of artificial intelligence, machine learning, or large language models.
  • Introduce malware, viruses, or other harmful code.
  • Attempt to gain unauthorized access to any part of the website or its underlying systems.

2.3 Intellectual Property and AI Use

All content on obeya.studio — including text, graphics, methodology frameworks, training materials, and the Obeya.studio brand — is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit any content without our prior written consent.

The Leading with Obeya (LWO) methodology is developed by Tim Wiegel. Obeya.studio operates as the official U.S. distributor of LWO. All LWO trademarks and materials remain the property of their respective owner.

Use of content by artificial intelligence systems. The content on this website is published for human readers and conventional search-engine indexing. Without our prior written consent, the following uses are not permitted:

  • Automated extraction, scraping, mirroring, or bulk download of content from this website.
  • Use of any content — including text, images, training materials, methodology descriptions, and code samples — for training, fine-tuning, embedding, retrieval-augmented generation (RAG), or otherwise developing or improving artificial intelligence, machine learning, or large language models.
  • Republication, redistribution, or rehosting of any content on third-party platforms.

Real-time retrieval by an AI assistant acting on behalf of a human user (for example, when a person asks ChatGPT, Claude, Perplexity, or a similar assistant a question and the assistant fetches a page to answer) is permitted, provided the assistant's response includes proper attribution and a link back to the source page.

Compliance with the directives in our robots.txt file is required. The absence of a technical block does not constitute permission.

2.4 Services and Engagements

Descriptions of consulting, coaching, and training services on this website are for informational purposes only and do not constitute a binding offer. All engagements are subject to a separate written agreement or statement of work.

We reserve the right to decline any inquiry or engagement at our discretion.

2.5 Disclaimer of Warranties

The website and its content are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses.

2.6 Limitation of Liability

To the fullest extent permitted by applicable law, Obeya.studio and David van Noort shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or our services.

Our total liability for any claim relating to this website or our services shall not exceed the amount paid by you for the specific service giving rise to the claim, or $100 USD if no payment has been made.

2.8 Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in New York, NY, under the rules of the American Arbitration Association.

Nothing in these Terms limits your rights under applicable consumer protection laws.
